VAWA – Green Card Option for domestic victims

VAWA (Violence Against Women Act of 1994)

I. Eligibility

  1. Abused spouses or former spouses of U.S. citizens or lawful permanent residents
  2. Abused children of a U.S. citizen or lawful permanent resident
  3. Spouses or former spouses (whether abused or not) whose children are abused by their U.S. citizen or lawful permanent resident spouse
  4. Parents who are victims of elder abuse by a U.S. citizen son or daughter
  5. Battered spouse waiver applicants
  6. VAWA Cuban adjustment applicants
  7. VAWA HRIFA (Haitian) applicants
  8. VAWA NACARA applicants (Nicaraguans, Cubans, Salvadorans, Guatemalans, Former Soviet Union nationals)

II. Requirements

  1. Relationship to the abuser
  2. The abusive spouse or parent is a U.S. citizen or Legal Permanent Resident
  3. Residence within the U.S.
  4. Residence with the abuser
  5. Battery or extreme cruelty
  6. Good moral character
  7. Marriage in good faith
